These Terms of Service (“Terms”) govern your use of the HyperResponder mobile application, website, and related services operated by VYKO TECHNOLOGIES LTD (“VYKO”, “we”, “our”, “us”).
By downloading, accessing, or using HyperResponder, you agree to these Terms. If you do not agree, you must not use HyperResponder.
1. Who Can Use HyperResponder
You must be at least 16 years old to use HyperResponder.
You may not use HyperResponder if doing so is prohibited by law in your country or region. By creating an account or using the app, you confirm that you meet these requirements.
2. What HyperResponder Does
HyperResponder is a workout logging and progress tracking app.
The app allows you to enter workout information, including free-form training notes, and converts that information into structured workout data such as exercises, sets, reps, weights, bodyweight exercise tracking, calorie burn estimates, workout history, progress trends, achievements, and related insights.
HyperResponder uses AI and natural language processing to help interpret workout entries. AI output may be incomplete, inaccurate, or misread your input. You are responsible for checking your logs and correcting any errors.
HyperResponder does not provide medical, nutritional, physiotherapy, or professional health advice. Any insights, scores, estimates, calorie burn calculations, or recommendations are for general fitness tracking only. Always use your own judgement and consult a qualified professional before starting, changing, or stopping any training, exercise, diet, or health routine.
You use HyperResponder at your own risk.
3. Accounts and Login
To use HyperResponder, you may need to create an account.
Supported login methods may include email and password, Google sign-in, and Apple sign-in. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You must provide accurate information and keep your account information up to date. You must not impersonate another person or create an account for someone else without permission.
4. Your Content and Workout Data
You retain ownership of the content you enter into HyperResponder, including workout logs, notes, custom program information, achievements, and any shared logs or achievements.
By submitting content to HyperResponder, you grant VYKO a non-exclusive, worldwide, royalty-free licence to process, store, display, analyse, back up, and transmit that content where necessary to operate, maintain, secure, and improve the service.
This includes processing your workout text through AI systems so the app can parse and structure your workout entries.
You are responsible for the content you submit and share. You must not submit content that is unlawful, abusive, discriminatory, misleading, harmful, or infringes someone else’s rights.
5. Sharing Features
HyperResponder may allow you to share workout logs, achievements, or related app content.
You are responsible for anything you choose to share. Do not share information that you want to keep private. If you share content outside the app or through platform sharing tools, that sharing may also be governed by the terms and privacy policies of the relevant platform or service.
We may remove shared content or restrict sharing features if we believe content breaches these Terms or creates risk to the service, other users, or VYKO.
6. Acceptable Use
You agree not to:
interfere with, disrupt, overload, or damage the app, website, servers, or infrastructure;
reverse-engineer, copy, scrape, exploit, or misuse any part of the app, design, code, AI systems, or proprietary logic;
attempt to gain unauthorised access to accounts, systems, data, or infrastructure;
use HyperResponder to track, monitor, or profile another person without consent;
upload unlawful, harmful, abusive, discriminatory, or infringing content;
misuse sharing features, referrals, promotions, subscriptions, or ads;
bypass paywalls, subscription checks, usage limits, or technical restrictions;
use automated systems to abuse the service.
We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use creates legal, security, operational, or reputational risk.
7. Free Features, Paid Features, and Subscriptions
HyperResponder may offer free features and paid features.
Paid features may include advanced logging, analytics, insights, limits, recommendations, progression tools, or other premium functionality shown in the app.
Subscriptions and in-app purchases are processed through Apple’s in-app purchase system. We use RevenueCat to manage paywalls, purchase validation, subscription status, and entitlement access.
We do not directly collect or store your full payment card details.
Prices, trial terms, renewal periods, and subscription details are shown before purchase. Subscriptions renew automatically unless cancelled through your Apple account settings before the renewal date.
Refunds, cancellations, and billing disputes are handled according to Apple’s App Store policies. We cannot guarantee refunds outside the relevant platform’s rules.
If HyperResponder becomes available through Google Play, Google Play purchases will be handled through Google’s own in-app purchase system and subject to Google Play’s terms.
8. Advertising
HyperResponder may show ads in the app, particularly for free users or free-tier experiences.
We do not share your workout entries, private notes, or personal workout data with advertising networks for ad targeting.
Ads may be delivered or controlled through platform-level or third-party advertising systems. Those systems may process device, app, or advertising identifiers according to their own terms and privacy policies.
Ad availability, frequency, and format may change over time.
9. Intellectual Property
HyperResponder, including its name, branding, design, interface, software, features, algorithms, content, databases, documentation, and related intellectual property, belongs to VYKO TECHNOLOGIES LTD or its licensors.
You are granted a limited, personal, non-transferable, non-exclusive, revocable licence to use HyperResponder for its intended purpose, subject to these Terms.
You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from HyperResponder except where permitted by law.
10. App Store Terms
Your use of HyperResponder may also be subject to the Apple App Store terms, Apple Media Services terms, and any applicable platform rules.
If there is a conflict between these Terms and mandatory Apple App Store rules, the relevant Apple rules apply to the extent required.
11. Service Availability and Changes
We aim to keep HyperResponder available and reliable, but we do not guarantee uninterrupted access.
We may update, modify, suspend, restrict, or discontinue any part of the app, website, features, subscriptions, ads, AI systems, or service at any time.
Some features may be experimental, limited, region-specific, or changed after release.
12. Fitness and AI Disclaimer
HyperResponder is a tracking and productivity tool, not a medical device.
Workout analysis, calorie burn estimates, progress scores, rankings, AI-generated outputs, and recommendations may be inaccurate or unsuitable for your circumstances.
You are responsible for training safely, using correct technique, avoiding unsafe loads or movements, and seeking professional advice where appropriate.
We are not liable for injuries, health issues, training outcomes, missed goals, inaccurate logs, incorrect estimates, or decisions you make based on the app.
13. Limitation of Liability
HyperResponder is provided “as is” and “as available”.
To the fullest extent permitted by law, we exclude warranties, representations, and conditions not expressly stated in these Terms.
We are not liable for indirect, incidental, special, consequential, or punitive losses, including loss of data, loss of profits, loss of goodwill, business interruption, device issues, training outcomes, or reliance on app outputs.
Where liability cannot be excluded, our total liability to you will not exceed the amount you paid for HyperResponder in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
14. Account Deletion and Termination
You may delete your account through the app by going to Settings and opening Account Settings..
We may suspend or terminate your account if you breach these Terms, misuse the service, create risk for VYKO or other users, or where we are required to do so by law.
After termination, some sections of these Terms will continue to apply, including intellectual property, disclaimers, limitation of liability, governing law, and any provisions needed to interpret or enforce these Terms.
HyperResponder does not currently offer a self-serve export feature. If you want to request a copy of your account or workout data, contact support@hyperresponder.comWe may need to verify your identity before responding to account or data requests.
Deleting your account does not automatically cancel an active Apple subscription. If you want to stop future billing, you must cancel your subscription through your Apple account settings.
15. Privacy
Our Privacy Policy explains how we collect, use, store, and share personal data.
By using HyperResponder, you acknowledge that your data will be handled in accordance with our Privacy Policy.
16. Changes to These Terms
We may update these Terms from time to time.
If we make significant changes, we may notify you through the app, website, email, or other reasonable method. Continued use of HyperResponder after changes take effect means you accept the updated Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have rights under the mandatory laws of your country or region of residence.
Disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
